Former Heroes star Adrian Pasdar was arrested in January for allegedly driving under the influence; but it appears that his case is far from over, as he has entered a not guilty plea.
The actor ironically played a lawyer-turned senator on the NBC television show, but needless to say he had to hire a lawyer for his own real-life case. His Los Angeles DUI defense lawyer pleaded not guilty to a misdemeanor charge of drunk driving on his behalf, according to E! Online. Mr. Pasdar didn't even show up to his own arraignment, which was held last week. Instead, the Los Angeles DUI defense laywer showed up in court to represent the actor.
Mr. Pasdar's DUI charge stems from his January 27 arrest, in which Los Angeles police officers saw the 44-year-old actor straddling two lanes with his Ford F-150 on Interstate 405. He was allegedly traveling at speeds that reached 94 mph, according to police. But what's most interesting about Mr. Pasdar's DUI case is that he is being charged for driving under the influence even though prosecutors have no record of what Mr. Pasdar's blood-alcohol level was the night of his arrest. According to the Daily Contributor, the actor refused a Breathalyzer test. But because the actor showed signs of impairment, he was taken into custody and had his bail set for $15,000.
Because Mr. Pasdar reportedly refused a take a Breathalyzer test, it might be difficult for prosecutors to prove that he was drunk at the time of the incident. However, it's important to realize that refusing a breath test has consequences as well. Refusing to take a breath test can result in a license suspension for up to one year, and additional charges can be applied in addition to DUI charges. Mr. Pasdar's preliminary hearing is scheduled for March 15.
